Subscription & Activity Agreement

This Bouraq.net subscription & activity agreement (hereinafter referred to as "this Agreement") stipulates that the user (hereinafter referred to as "you") in: Bouraq.net has the right to subscribe and automatically renew subscription until cancelled. Before you agree to this agreement, please carefully read and fully understand the rules and requirements of Bouraq.net, as well as the laws and regulations under which Bouraq.net operates. If you object to any of the terms of this agreement, you may choose not to use it; using it means that you will agree to abide by all the provisions of this Agreement and any subsequent amendments we may make to the use agreement from time to time. Otherwise, if you are 18 years old or above, please confirm that you have the ability to use the services.

Article 1. General Provisions

1.1 Bouraq.net platform is a more convenient video social media platform provided by Bouraq.net team (hereinafter referred to as "the team") for users to conduct live video, watch live video, video chat services, upload video, capture video and interact with other registered users in text, voice, video, and subscription to content creators. Bouraq.net platform will provide users with subscription access, technical support, traffic entrance and other services for video social networking.

1.2 You agree to the pertinence of the service and the cost investment, and agree to pay the corresponding subscription fees according to the content provider request. The Bouraq.net platform guarantees that the subscription rules equally apply to the same users. You agree to this agreement before using the above services and online interaction.

1.3 The final interpretation right of this agreement belongs to Bouraq.net. Bouraq.net has the right to revise and change the protocol, rules and code of conduct of Bouraq.net platform (such as website and mobile apps) regularly or irregularly. After the change, we will inform you and need you to agree to this agreement again. We hope you understand and agree to this.

Article 2. Service rules for subscriptions

2.1 Bouraq.net is using a third party payment gateway to ensure subscription transactions. The currency of the subscriptions will be either in USD or in EUROS. Third party will collect the payments and process them to Bouraq.net. If you are a content creator, you agree that Bouraq.net will deduct 40% from the subscription fee for administrative cost and will share with you 60% of the subscription fee. Distribution of subscription fees are done on monthly or quarterly basis. 

2.2 As a content creator, you have the right to charge a subscription fee to your profile ranging between $1 and $5 a month. No subscription fee is permitted beyond the parameteres stipulated under 2.2. As a user, you have the right to subscribe to as many content creators as you want. Subscription fees will be automatically renewed until you cancel your subscription from month to month.

2.3 As a user, you cannot watch any content of any content creator profile without a valid subscription. As a content creator, you are not allowed to provide access to your profile content, whether live or on-demand, without a valid subscription for your followers/users.

Article 3. Punishment rules

3.1 In case of any of the following circumstances, Bouraq.net platform has the right to interrupt or terminate the services provided to you under this agreement at any time without notice to you:

(1) The personal data you provided is not accurate;

(2) You violate the subscription rules set forth in this Agreement;

(3) You violate the Bouraq.net live broadcast rules and/or to participate in live broadcast, and/or interacting with video content. Those rules are valid for both content creators and ordinary users/subscribers. Bouraq.net platform does not have to bear any responsibility to you or any third party for any loss caused by the interruption or termination of the services.

3.2 If a subscriber/user or a content creator uses an improper vocabulary of bad words, swear words, insults, accusations, vocabulary of racism, calls for violence, sexual harassment, sexual insinuations, guns, drugs, pornography, or religious radicalization of any kind under a live broadcast, in an uploaded video, in a captured video, in comments, or in interactions, the account in question will be terminated without further notice.

3.3 if you as a subscriber/user and/or a content creator use improper means (including but not limited to violating platform rules, exploiting system or rule vulnerabilities, using plug-ins or other cheating programs, spamming, etc.), directly or indirectly, Bouraq.net platform has the right to terminate your account and prohibit you from using various services.

3.4 You promise as a subscriber/user and as a content creator to abide by the principle of good faith, do not disturb the normal order of Bouraq.net platform, do not publish commercial advertisements of any kind without the consent of Bouraq.net, and do not engage in activities unrelated to rules and provisions of this agreement.

3.5 Your registered account number and password are the only identity certificate for you to accept the platform service. You are responsible for keeping and setting the password. It is forbidden to give, borrow, rent, transfer or sell. You should take full legal responsibility for all activities and events with your account.

3.6 You promise that the above information includes but is not limited to all kinds of accounts used in Bouraq.net, third-party payment accounts, corresponding passwords and other important information, and will not be disclosed in the process of live broadcast or other use of platform services, nor will you publish, upload or provide information involving your privacy to other people through platform services, otherwise you shall bear the responsibility and losses arising therefrom.

3.7 You promise not to do anything harmful to the image and brand of Bouraq.net, otherwise Bouraq.net has the right to terminate the agreement, close the account and ask you to bear all legal and compensation liabilities.

3.8 During the term of this Agreement and after the termination of this agreement, you are not allowed to spread and publicize any speech, picture, video, etc. that is harmful to the reputation and image of Bouraq.net in any way, spread any false information in any way, and damage the interests of Bouraq.net in any way, such as encouraging Bouraq.net users. Otherwise, Bouraq.net has the right to ask you for compensation.

3.9 If a third party participates in your live broadcast, you should guarantee that there is no legal dispute with the third party. If there is any dispute, you are solely responsible for it and have nothing to do with Bouraq.net. If Bouraq.net suffers losses, you should compensate Bouraq.net for such losses.

3.10 You promise to actively maintain the image of Bouraq.net, and you shall not do anything harmful to the image or interests of Bouraq.net or Bouraq.net platform. During the term of this Agreement and after the termination of this agreement, you are not allowed to express any opinion suggestive of or unfavorable to Bouraq.net or its platform in any form through any channel.

3.11 You are not allowed to mention or display the name, logo, registration number and picture of other live broadcasting platforms in any form (including but not limited to personal news, personal information page, live room name, poster, text, voice, video, picture, background, setting, etc.) on any occasion. You are not allowed to guide existing users of Bouraq.net platform, other anchors or Bouraq.net employees to enter otherwise, Bouraq.net has the right to punish your breach of contract.

3.12 Bouraq.net only provides platform services. If you establish a contractual relationship with a studio, brokerage company or other third party organization, all disputes arising from this have nothing to do with Bouraq.net, and Bouraq.net will not assume any responsibility.

Article 4. Modification, rescission and termination of the agreement

4.1 Bouraq.net has the right to change or terminate this agreement when necessary.

4.2 Bouraq.net has the right to terminate the agreement immediately if you have any of the following circumstances:

(1) Bouraq.net finds that you have violated the statements and commitments made in this Agreement;

(2) Direct or indirect damage to the interests of Bouraq.net caused by your personal behavior;

(3) Violating the laws, regulations or normative provisions of the EU law;

(4) Breach of other obligations stipulated in this Agreement.

Article 5. Intellectual property rights

5.1 Bouraq.net video / voice service includes Bouraq.net website, mobile application software, text, pictures, videos, audios, and other elements are the sole intellectual properties of Bouraq.net. Bouraq.net owns all intellectual property rights of its service logo, logo and any of the above elements.

5.2 You are not allowed to reverse engineer, reverse assemble or reverse compile the relevant web pages, applications, software and other products involved in the platform services.

5.3 You license Bouraq.net free, permanent, irrevocable, exclusive and sublicense rights all over the world, including but not limited to: reproduction rights, distribution rights, the right to exercise, lease, exhibition, performance, projection, broadcasting, information network transmission, film production, adaptation, translation, compilation and other copyright property rights and neighboring rights as stipulated in the copyright law.

Article 6. Others

6.1 This agreement can be updated by Bouraq.net at any time. Once the updated agreement terms are published, they will replace the original agreement terms without further notice. You can check the latest version of the agreement terms on Bouraq.net platform. If you do not accept the modified terms after Bouraq.net modifies the terms of the agreement, please stop using the services provided by Bouraq.net immediately. If you continue to use the services provided by Bouraq.net, you will be deemed to accept the modified agreement.

6.2 Any dispute related to this Agreement shall be settled by both parties through negotiation. If you have any questions or complaints about the use of this agreement, please contact our support at support@bouraq.net

5.3 If any provision of this agreement is invalid or unenforceable in whole or in part for any reason, other provisions of this Agreement shall still be valid and binding. Bouraq.net platform and users (both creators and subscribers) shall try their best to embody the original intention of this agreement.
